Terms & Conditions

Definitions;

The Client – The person(s) requesting the services of Eco Pods (SW) Ltd
The Contractor – Eco Pods (SW) Ltd & any appointed sub-contractors
The Premises – The location that the Eco Pod will be constructed upon and will require access.
The Project – The construction of the Eco Pod from start to finish.

The Client acknowledges they are fully responsible for the acceptance of any quotations provided and are bound to these terms and conditions accordingly. The Client acknowledges that they are the rightful decision maker and have the authority to allow for any agreed works to go ahead at The Premises.

1. Quotations

1.1 We produce our quotes with as much detail as possible to avoid any misunderstanding / misleading circumstances. If something is missing from you’re your quote that you would like to be included, please let us know and we will revise the quotation accordingly.
1.2 We can provide an additional quote for any additional works that are found necessary, this is to be agreed with The Client separately from the original quote. As an addendum to the original quote, a separate contract may be deemed necessary in order carry out the relevant works.
1.3 All of our pricing and quotes are calculated on the basis of free access and unimpeded working hours discussed with The Client.
1.4 The Client will be deemed to have accepted these terms and conditions if they have accepted a quote, orally or in writing, and have allowed the commencement of work to take place.
1.5 The pricing reflected within the quote or any estimated costs may be revised in the event of any circumstantial changes or unforeseen difficulties that may arise to reflect the situation at hand.

2. Ownership of Materials

2.1 All building and other materials provided by The Contractor or their sub-contractors remain the property of Eco Pods (SW) Ltd until full and final payment is received via Bank Transfer (see section 5).
2.2 The Client must provide access to and collection of any used or unused building materials, equipment and plant etc until the full and cleared final payment is received.
2.3 Any materials that are deemed unrealistic or not cost-effective to remove from The Premises shall be at the discretion of The Contractor to leave or remove from The Premises.

3. Payments

3.1 Payment can be made via Bank Transfer. Bank Transfer details are listed on invoices and are available upon request.
3.2 The initial 50% of the total quotation price (the deposit) is due to start The Project and the remaining 50% (Payment in full) is due on the completion date of The Project. The deposit is non-refundable as these funds will be used to purchase materials and make all necessary preparations for The Project.

4. Working Environment

4.1. The Client is responsible for presenting The Premises with consideration of The Contractor and providing a clean, dry working area where possible.
4.2. Both The Contractor and The Client agree to discussing practical arrangements on working methods that allow work to be carried out efficiently by The Contractor and that provide minimum disruption to The Client.
4.3. Delivery of materials, plant, machinery and skips etc are likely to occur during The Project. The Contractor requires free access for things of this nature to fulfil their duties.

5. Sub-Contractors

5.1 Eco Pods (SW) Ltd may employ both direct and sub-contract labour to work at The Premises and on The Project. Each individual contractor takes full responsibility for their own third-party liability. Eco Pods (SW) Ltd will oversee all works to completion and takes full general and operational responsibility in the running of The Project agreed with The Client.

6. Insurance

6.1 Public Liability Insurance is provided up to the sum of £2,000,000. Insurance details can be obtained on request.

7. Carrying Out Works

7.1 We strive to maintain a helpful and professional attitude at all times and will always attempt to bring the works to a satisfactory conclusion as soon as possible, taking into account weather conditions and availability of specialist materials and unforeseen circumstances etc.
7.2 Work on The Project will not be able to be carried out in poor / wet weather conditions.
7.3 Any extra services, products or materials will only be provided further to additional agreement with The Client and via an additional accepted quote.
7.4 If for any reason works cannot be carried out due to The Premises not being ready or through any other fault of The Client, all wasted visits will be charged at £350 per person per day under 30 miles from BS23 and £500 per person per day for jobs over 30 miles from BS23.

8. Guarantees

8.1 The Client will benefit from a workmanship guarantee for a period of 5 years upon the date of completion of The Project.
8.2 Guarantees on materials / products used run in accordance with manufacturer’s warranty periods where applicable.
8.3 Our guarantee covers all new work and new materials used during The Project, but does not guarantee the integrity of any existing foundations, structures or materials carried out by other parties.
8.4 In the unlikely event there is an issue with your Eco Pod, please notify us within 14 days (of completed works) so that we can rectify this as soon as possible and possibly preventing further damage.
8.5 In the event of a failure beyond the guarantee period, we will be happy to investigate the cause and negotiate a solution to the problem and provide a quote to carry out any agreed repairs. Some charges may apply for remedial work carried out beyond guarantee dates or to items not covered by our guarantee.
8.6 Our guarantee does not cover any damage caused by negligence of The Client, accidental or with intent.

The General Data Protection Regulation (GDPR)
By agreeing to a quotation and therefore these terms and conditions, you are also consenting to your personal data being shared with third parties for the purposes of fulfilling the agreed works. Personal data includes title, name, address, phone and email numbers. This data will be used to provide any documentation or any further necessary correspondence and will be retained by Eco Pods (SW) Ltd for a period not exceeding 10 years.
